WHO IS BAGNATO CONVEYANCING?

The principal of Bagnato Conveyancing is Rosalinde Bagnato a Certified Practising Conveyancer with a Dip. in Business & an Adv. Dip. in Conveyancing.  Her practise is accredited by the Australian Institute of Conveyancers NSW Division Ltd.

A licensed Conveyancer is a specialist who deals only in the legal transfer of real property.  To carry on a business, a licensed Conveyancer must be qualified with a minimum of two years legal conveyancing experience, as well as undertake yearly ongoing professional education programs.                  

A Certified Practising Conveyancer must be insured and hold a Certificate of Currency.

OVERVIEW OF THE CONVEYANCING PROCESS

Vendors/Sellers

  • Instruct your Conveyancer as to the property being sold
  • Provide a current Council rate notice
  • Provide your selling agents details
  • Your conveyancer will provide the selling agent with a draft contract
  • Effect an exchange once the property has been sold
  • Liaise with your mortgagee, if necessary
  • Check the settlement statement once received
  • Provide you with regular updates and a copy of the settlement statement
  • Organize settlement with Purchaser's representative and your mortgagee
  • Receive a payout figure from your outgoing mortgagee, if applicable
  • Complete settlement, discharge your mortgagee hand the keys to the buyer
  • Make sure the balance of the moneys for the property is correct and handed over to you.
  • Finalize the transaction by providing you with final settlement letters and documents.

If you have a simultaneous settlement, meaning that you are selling and buying at the same time we will organize a simultaneous settlement using the funds from your sale for your purchase and make sure that settlement for both properties takes place and are finalized at the same time.

Buyer/Purchaser

  • Instruct your Conveyancer
  • Provide your conveyancer with a contract and have them go through it for you
  • Make sure your finances are in place before committing to buying a property
  • Do pre-exchange property searches (eg. pest and building report or a strata report)
  • Once your offer to buy has been accepted let your conveyancer know , so that they will
  • negotiate amendments to the contract, if required, before exchange is effected
  • Effect an exchange of contracts
  • Do the standard property searches which include: land tax, local gov.searches and rate notices
  • Liaise with your incoming mortgagee
  • Stamp your transfer and contract
  • Liaise with the Sellers representative and organize settlement time and place
  • Provide the Vendor and yourself with a settlement statement showing the final amount to be paid on settlement
  • Organize settlement with your incoming mortgagee, if applicable
  • Effect the settlement, hand over settlement monies and organize the handing over of the keys
  • Provide you with settlement letters and documents finalizing the conveyancing transaction
